Terms of Service
Last updated: August 4, 2026 · Effective for all BisaFund users in Ghana
Please read these Terms of Service carefully before using BisaFund. These terms govern your use of our crowdfunding platform, including creating campaigns, making donations, and receiving funds.
1. Acceptance of Terms
By accessing or using BisaFund ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. BisaFund is a software platform that connects donors with verified campaign organisers in Ghana.
2. Eligibility
You must be at least 18 years old and a resident of Ghana to create a campaign. Donors may contribute from anywhere BisaFund accepts payment. By using the Platform, you represent that all information you provide is accurate and truthful.
3. Campaign Creation & Content
Organizers are solely responsible for the accuracy of their campaign content, including the story, images, and stated purpose. BisaFund offers an optional AI-powered campaign assistant to help draft compelling descriptions, and may suggest AI-generated images during campaign creation as visual placeholders only. AI-generated images cannot be used as the cover photo on a published campaign — you must upload a real photograph that accurately represents your campaign before submitting it for review. You are responsible for reviewing, editing, and approving all content (including any AI-generated text) before publishing. BisaFund reviews campaigns before making them active but does not guarantee the accuracy of any campaign. Campaigns must be for lawful purposes. We reserve the right to remove any campaign that violates our policies, is fraudulent, misleading, or otherwise inappropriate.
3A. Campaign Status & Identity Verification
BisaFund distinguishes between campaign approval and identity verification. These are separate processes with separate meanings: (a) Active Campaign: When a BisaFund admin reviews and approves a campaign — including confirmation that the organizer has completed identity verification and linked a verified payout account — it becomes "Active" and can accept donations. This means the campaign content has been reviewed for compliance with our policies AND the organizer's identity has been verified. (b) Identity Verified: A campaign displays an "Identity Verified" badge after the organizer has completed Smile ID biometric KYC verification (government ID + selfie match) OR has received a manual identity override from a BisaFund admin after Smile ID verification failed. Identity verification is mandatory before a campaign can go live and accept any donations. (c) Important Distinction: Because identity verification is required before a campaign goes live, every Active campaign on BisaFund has a verified organizer. There are no Active campaigns with unverified organizers. This is because donations are routed directly to the organizer's verified account, so verification must be complete before any donation is accepted. (d) Verification is Not Endorsement: The Identity Verified badge confirms that the organizer's identity has been verified against a government database. It does NOT constitute an endorsement by BisaFund, does NOT guarantee the campaign is legitimate, and does NOT guarantee that funds will be used as described. Donors should always read the campaign story carefully and donate at their own discretion.
4. Platform Fees
BisaFund charges a platform fee of 5% on all successful donations — this is the only fee BisaFund charges. The platform fee is collected by our payment provider at the point of donation and remitted to BisaFund; BisaFund does not hold donor funds from which the fee is later deducted. Payment processing is handled by our third-party payment gateway, which charges its own processing fee on top of BisaFund's 5% platform fee; the exact processing rate depends on the payment method and is shown to the donor at checkout. There is no cost to create or start a campaign. Donors may optionally add a tip at checkout to help cover platform costs. Additionally, donors may choose to cover the 5% platform fee themselves by selecting the "I'll cover the 5% platform fee" option during checkout. When this option is selected, the 5% fee is added to the donor's total charge and the full original donation amount is routed to the organiser's verified account with no platform fee deducted. This option is entirely voluntary; if not selected, the standard 5% fee is collected by the payment provider at the point of donation. For corporate matching programs, fees are calculated on the original donation amount only, not on the matched portion. By creating a campaign on BisaFund, you acknowledge and agree to this fee structure.
5. Donations & Payments
All donations are processed via trusted Ghanaian payment providers. When a donor makes a donation, the payment provider routes the donation directly to the campaign organiser's verified mobile money or bank account, and routes BisaFund's 5% platform fee to BisaFund. BisaFund does not take custody of, hold, pool, or transmit donor funds — it is a software platform that connects donors with verified organisers. BisaFund supports MTN Mobile Money, Telecel Cash, AirtelTigo Money, and bank transfers. Donors receive a confirmation of their contribution. BisaFund does not store card or mobile money credentials.
6. How Organisers Receive Funds
Because donations are routed directly to the organiser's verified account by the payment provider, there is no withdrawal-request or admin-approval step — funds settle to the organiser as donations occur. The following terms apply to how organisers receive funds: (a) Verified Payout Account: Before a campaign can go live and accept donations, the organiser must link a mobile money number or bank account that has been verified to belong to them (the account holder name must match the organiser's verified identity — see Section 8). Donations are settled to this account. (b) No Holding Period: BisaFund does not hold donated funds. There is no minimum balance, no request frequency cap, and no admin release step, because funds are delivered directly by the payment provider as donations occur. (c) Fees at Point of Payment: The 5% platform fee and any processing fee are collected by the payment provider at the moment of donation, not deducted from a held balance. (d) Launch Incentive: Where BisaFund makes a Launch Incentive (Founding 50) contribution to a campaign, that platform contribution is subject to any fraud-review hold BisaFund applies to its own contribution; this does not affect the routing of donor funds, which settle directly to the organiser. (e) Funds Delivered Badge: Organisers may opt-in to display a "Funds Delivered" badge on their campaign page indicating that donations are settled directly to their verified account. Celebrity campaigns may display the total delivered amount; regular campaigns display the badge only. (f) Important — No Clawback: Because BisaFund never holds donor funds, it cannot freeze, reverse, or claw back donations once they have settled to the organiser's account. Donor protection is provided through upfront identity verification, content review, sanctions screening, and post-fraud suspension/reporting (see our Donor Protection page).
7. Recurring Donations
Donors may set up recurring weekly or monthly donations. Recurring donations can be cancelled at any time from the donor's account dashboard. BisaFund will attempt to process each scheduled payment but cannot guarantee success due to mobile money network conditions.
7A. Corporate Matching Programs
BisaFund offers corporate matching programs where corporate partners agree to match donations made to eligible campaigns. By participating in a matched campaign, you agree to the following: (a) Matched funds are subject to the corporate partner's payment terms and conditions; (b) Corporate matches may be reversed if the corporate partner fails to fulfill payment obligations; (c) Reversed matches will reduce your campaign's total matched amount; (d) You will be notified via email if a corporate match affecting your campaign is reversed; (e) Reversals may delay settlement of the matched portion until the discrepancy is resolved; (f) BisaFund reserves the right to reverse matches at any time to protect platform integrity and prevent fraud; (g) Corporate partners' matching commitments are separate agreements between BisaFund and the partner — you are not a party to that agreement and cannot enforce it directly.
7B. Celebrity Causes
BisaFund offers a "Celebrity Causes" feature that allows verified public figures to raise funds on the platform. By applying for celebrity status, you agree to the following: (a) Celebrity verification is a separate process from identity verification (KYC) — it requires social proof links, verification documents, and admin review of notable presence; (b) Only approved celebrity profiles are publicly visible on the Celebrity Causes hub; (c) Celebrity campaigns are flagged for a separate priority review track and must meet higher trust standards; (d) Your celebrity email is encrypted with AES-256-GCM and is never exposed in API responses to non-admin users; (e) Admin actions on your celebrity profile (approval, suspension, revocation, featuring) are fully logged in the audit trail; (f) BisaFund may suspend or revoke celebrity status at any time if fraud, misrepresentation, or policy violations are detected; (g) Celebrity status does not exempt you from mandatory KYC verification and a verified payout account before your campaign goes live; (h) You may delegate campaign management to team members, but payout-account permissions must be explicitly granted per team member and are subject to the campaign owner's discretion.
8. Verification & Identity (Progressive Verification)
BisaFund operates a three-tier progressive verification system to build trust between organisers and donors while minimising friction: Tier 1 — Email Verification (Required at Campaign Creation): All organisers must verify their email address via a one-time password (OTP) sent to their account email. This is required during campaign creation. OTPs expire after 10 minutes and must not be shared with anyone. Tier 2 — Campaign Creation (Basic Profile): Organisers provide their full name, email, phone number, and beneficiary information. Campaign content is reviewed by BisaFund before publication. Tier 3 — Identity Verification / KYC (Mandatory Before Campaign Go-Live): Before a campaign can go live and accept any donations, the organiser must complete full identity verification (Know Your Customer) using a valid government-issued ID — Ghana Card, Voter ID, Passport, or SSNIT card — along with a biometric selfie, and must link a payout account (mobile money or bank) whose holder name matches the verified identity. This verification is performed through our third-party identity verification partner, Smile ID, which checks your details against the Ghana government database and matches your selfie to your ID photo. No campaign will be approved to go live, and no donations will be accepted, until this is complete. (a) KYC verification is mandatory — no campaign will be approved to go live and no donations will be accepted until identity verification and payout-account verification are successfully completed. (b) The person who completes identity verification must be the same person who controls the linked payout account — if the verified identity does not match the payout account holder, the campaign will not be approved to go live. (c) If Smile ID verification fails, the organizer may request a manual review by the BisaFund compliance team, who may approve a manual identity override at their sole discretion after reviewing the submitted ID and selfie evidence. (d) BisaFund may, at its discretion, also require additional supporting documents (e.g., medical reports, school receipts) for high-value campaigns before approval. (e) Because verification is required before a campaign goes live, Account Health reminders encourage organisers to complete verification during campaign creation rather than after donations begin. (f) Campaigns that have completed identity verification (whether via Smile ID or admin manual override) display an "Identity Verified" badge on their campaign page. Verification does not constitute an endorsement by BisaFund. (g) By creating a campaign, you consent to your identity being verified by Smile ID, a licensed identity verification provider. Your personal data is processed in accordance with the Data Protection Act, 2012 (Act 843) of Ghana and our Privacy Policy.
8A. Account Security & Two-Factor Authentication
BisaFund supports optional TOTP-based two-factor authentication (2FA) for all user accounts. When enabled, you must provide a 6-digit time-based code from an authenticator app (e.g., Google Authenticator, Authy) in addition to your password when logging in. (a) 2FA uses RFC 6238 TOTP with SHA-1 and 30-second periods; (b) Upon enabling 2FA, you will receive 10 single-use recovery codes — store these securely, as they are the only way to regain access if you lose your authenticator device; (c) Recovery codes are stored as SHA-256 hashes and cannot be retrieved in plain text after initial display; (d) After 5 failed 2FA attempts, your account will be locked for 15 minutes to prevent brute-force attacks; (e) If you lose both your authenticator device and your recovery codes, you must contact BisaFund support to reset 2FA — this process requires identity verification; (f) BisaFund strongly recommends enabling 2FA, especially for campaign organisers and users handling large donation amounts. Celebrities and team members with payout-account permissions are strongly encouraged to enable 2FA before being granted financial access.
8B. Campaign Team Members & Delegated Access
Campaign organisers may invite team members to help manage their campaigns. By adding a team member, you agree to the following: (a) Team members are identified by their registered BisaFund email address; (b) You can grant team members roles (editor, manager) and optionally grant payout-account permission (can_withdraw); (c) Team members with payout-account permission can update the linked payout account on your behalf, subject to all standard verification rules (KYC, name-match); (d) The campaign owner is solely responsible for managing team member permissions and removing access when appropriate; (e) BisaFund logs all team member additions, updates, and removals in the audit trail; (f) Team members cannot remove the campaign owner or demote the owner's role; (g) If a team member's account is compromised, you must immediately remove their access and contact BisaFund support; (h) BisaFund is not liable for unauthorised actions taken by team members you have granted permissions to.
9. Prohibited Uses
You may not use BisaFund to raise funds for illegal activities, to deceive donors, to impersonate other individuals or organisations, to violate any applicable Ghanaian law or regulation, or to engage in any form of money laundering or financial fraud.
10. Fraud & Abuse
BisaFund employs automated and manual fraud detection to protect users and maintain platform integrity. Campaigns suspected of fraud, policy violations, or misleading content may be suspended pending review. Suspended campaigns remain visible to the public with a clear suspension notice, and further donations are immediately blocked. Organizers of suspended campaigns may appeal for reinstatement by providing additional documentation. Users who submit fraudulent campaigns may face temporary suspension or permanent banning. BisaFund cooperates with law enforcement authorities where required. For details on what constitutes policy violations, visit our Community Standards.
10A. Donor Acknowledgment & Responsibility
By making a donation on BisaFund, you acknowledge and agree that: (a) BisaFund is a software platform that connects donors with verified organisers — it does not hold, pool, or transmit donor funds. Donations are routed directly to the organiser's verified mobile money or bank account by the payment provider; (b) Every Active campaign has an organiser who has completed Smile ID biometric KYC and linked a verified payout account — the "Identity Verified" badge confirms identity only and does NOT guarantee that the campaign is legitimate or that funds will be used as described; (c) BisaFund is not liable for the authenticity, accuracy, or completeness of any campaign content created by organisers; (d) You donate at your own discretion and accept the risk that a campaign may not fulfil its stated purpose, regardless of verification status; (e) BisaFund's fraud detection and verification systems reduce but do not eliminate the risk of fraudulent campaigns. BisaFund does not hold donor funds — if fraud is detected, BisaFund will suspend the campaign, block further donations, and cooperate with law enforcement, but cannot reverse or recover funds that have already settled to the organiser's account; (f) Your donation is a voluntary contribution and is not an investment, loan, or guarantee of any outcome; (g) The Identity Verified badge confirms identity only — it does not verify the truthfulness of the campaign's stated purpose, the severity of medical or emergency claims, or how funds will ultimately be used after settlement.
11. Sharing & Social Features
BisaFund provides built-in sharing tools including WhatsApp, Facebook, and Twitter/X. You are responsible for how you share campaigns. Do not share campaigns in ways that constitute spam or harassment. Community features such as comments and likes are subject to our content standards.
12. Intellectual Property
All content you upload remains yours. By uploading content to BisaFund, you grant us a non-exclusive licence to display and distribute it on the Platform for the purpose of running your campaign. BisaFund's branding, logo, and platform design are our intellectual property.
13. Limitation of Liability
BisaFund is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Because BisaFund does not hold or transmit donor funds, BisaFund is not liable for the loss of donated funds once they have been settled to an organiser's verified account by the payment provider. Our total liability to any user shall not exceed the fees collected by BisaFund in the three months prior to the event giving rise to the claim.
13A. User-Uploaded Content & Image Liability
Users are solely responsible for all images, text, and other content they upload to BisaFund. By uploading content, you confirm that: (a) you own the content or have obtained all necessary rights and permissions to use it; (b) the content does not violate any third-party copyright, trademark, or privacy rights; (c) the content is not defamatory, obscene, hateful, or otherwise unlawful. BisaFund does not pre-screen user-uploaded content and is not liable for the accuracy, legality, or appropriateness of images or text uploaded by campaign organisers. BisaFund reserves the right to remove any content at its sole discretion if it is deemed inappropriate, misleading, or in violation of these Terms. If you encounter inappropriate or copyrighted content on a campaign, you can report it by using the "Report" button on the campaign page. Reports are reviewed by our compliance team and may result in content removal, campaign suspension, or account termination. BisaFund is not liable for any damages arising from user-uploaded content displayed on the Platform.
14. Language & Localisation
BisaFund supports English and French. Content may be translated automatically or manually. While we strive for accuracy, translations are provided on an "as-is" basis. In case of discrepancies, the English version shall take precedence. Users are responsible for understanding the terms in their selected language.
15. AI-Generated Content & Images
BisaFund provides optional AI tools to assist with campaign creation, including: (a) an AI campaign assistant that helps generate campaign descriptions and story text, and (b) AI-generated image suggestions that serve as visual placeholders during the campaign creation process. You are solely responsible for reviewing, editing, and approving any AI-generated text before publishing. BisaFund does not warrant the accuracy or suitability of AI-generated descriptions. AI-generated images are provided as draft placeholders only — they cannot be used as the cover photo or primary image on a published campaign. You must upload a real photograph that accurately represents your campaign before submitting it for review. This policy exists to maintain donor trust and prevent the use of misleading or fabricated imagery. Campaigns that attempt to circumvent this requirement may be rejected during review. Generated text content must be truthful and comply with our Fraud & Abuse policy. Campaigns using AI-generated content that later prove fraudulent or misleading may be suspended.
16. AI-Powered Blog & Platform Content
BisaFund publishes an AI-generated blog to share fundraising tips, platform news, and community stories. All AI-generated blog content is reviewed against safety and accuracy standards before publication. User-submitted campaign content is never used to generate blog posts. The AI blog system operates on a fixed, internal topic pool and is not influenced by external user inputs. BisaFund does not warrant the accuracy of AI-generated articles; they are provided for general informational purposes only.
17. Campaign Suspension & Reinstatement
BisaFund may suspend campaigns at any time if they violate these Terms, our Community Standards, or Ghanaian law. Suspended campaigns are clearly marked with a suspension notice visible to all visitors, and further donations are blocked immediately. Organisers are notified of the reason for suspension via email. Organisers may appeal for reinstatement by submitting additional documentation or clarification to our compliance team within 30 days. Reinstatement decisions are final and made at BisaFund's sole discretion. Campaigns that have been suspended more than once for similar violations may be permanently removed from the Platform.
17A. Corporate Match Reversals
BisaFund reserves the right to reverse corporate matching funds under the following circumstances: (a) Non-payment by corporate partner — if the corporate partner fails to remit matched funds within agreed timelines; (b) Fraud detection — if the matched donation is found to be fraudulent or in violation of platform policies; (c) Partner request — if the corporate partner requests reversal due to budget constraints or changed priorities; (d) Administrative adjustment — to correct errors, duplicates, or system glitches. When a match reversal occurs: (i) The campaign's matched total will be reduced by the reversal amount; (ii) The campaign organizer will receive an email notification with detailed explanation; (iii) The reversal will be recorded in the platform's audit trail; (iv) Settlement of the matched portion may be delayed until the reversal is processed; (v) The corporate partner will be notified for non-payment cases. All reversals are final and documented for compliance purposes.
18. User Accountability
All users agree to be accountable for their actions on the Platform. Any attempt to circumvent our fraud detection systems, create duplicate accounts after suspension, or manipulate campaign data may result in permanent platform banning and legal action where applicable.
18A. Demo & Example Campaigns
BisaFund may display example/demo campaigns on the platform to illustrate how fundraising works for visitors. These campaigns are clearly marked with an "Example" label and are not real fundraising campaigns. Demo campaigns are excluded from all platform metrics, transparency statistics, and admin growth dashboards. Donations made to demo campaigns (if any) are also excluded from real platform financial reporting. By using BisaFund, you acknowledge that demo content exists for illustrative purposes only and does not represent real campaigns or real donations.
19. Changes to Terms
We may update these Terms from time to time. Continued use of BisaFund after changes constitutes your acceptance of the new Terms. We will notify registered users of material changes via email.
20. Governing Law
These Terms are governed by the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.
